General Terms and Conditions (GTC)

These General Terms and Conditions (“GTC”) apply to all contracts concluded between Turn On Computer Resale GmbH (“Seller”, “we”, “our”) and its customers (“Customer”) via our website, online marketplaces, or other sales channels.

Different terms proposed by the Customer shall not apply unless expressly agreed in writing.

We sell both new and professionally refurbished (used) IT equipment and accessories.

Unless otherwise stated:

• All used products are professionally tested.
• Fully functional.
• Thoroughly cleaned.
• Securely packaged before shipment.
• May show normal signs of previous use.

The cosmetic condition is individually described in each product listing.

All prices are shown in Euro (€).

Where applicable, prices include the statutory German VAT.

Accepted payment methods are displayed during checkout.

Orders remain the property of Turn On Computer Resale GmbH until full payment has been received.

Orders are shipped using reputable shipping providers.

Estimated delivery times are non-binding and may vary depending on the shipping carrier.

Customers are responsible for providing the correct delivery address.

Additional shipping costs may apply for remote regions or international destinations.

Customers are requested to inspect the package immediately upon delivery.

If visible transport damage is detected:

• Report the damage within 72 hours whenever possible.
• Take photographs of the unopened package.
• Record a continuous video while opening the package.
• Keep all original packaging materials until the investigation has been completed.

This documentation helps us verify transport damage and process claims with the shipping carrier more efficiently.

Failure to provide photos or video does not affect statutory consumer rights but may delay or make it more difficult to investigate transport damage claims.

Unless otherwise stated, we provide a 12-month commercial warranty from the invoice date.

The warranty covers manufacturing defects and technical failures occurring during normal and intended use.

The warranty does not cover:

• Accidental damage
• Improper handling or misuse
• Liquid damage
• Fire or heat damage
• Power surges
• Unauthorized repairs or modifications
• Cosmetic damage not affecting functionality
• Normal wear and tear
• Batteries and other consumable parts unless defective upon delivery

Warranty service may consist of repair, replacement, or refund at our discretion where legally permissible.

Nothing in these Terms and Conditions limits or excludes any mandatory statutory rights granted to consumers under German or European law.

Consumers benefit from the statutory 14-day right of withdrawal, where applicable.

Details regarding the withdrawal procedure are provided in our separate Right of Withdrawal Policy (Widerrufsbelehrung).

Business customers do not receive a voluntary right of return unless expressly agreed in writing.

Mandatory statutory rights remain unaffected.

Returned products should:

• Include all supplied accessories.
• Be safely packaged.
• Include the original order number.

Products returned with transport damage caused by insufficient packaging may be subject to a reduction in the refund where legally permitted.

Refunds are processed after inspection of the returned goods.

Before returning any electronic device, customers must remove:

• Personal files
• Passwords
• Apple ID
• Microsoft Account
• Google Account
• BIOS passwords
• Other activation locks

Turn On Computer Resale GmbH is not responsible for personal data remaining on returned devices or for any data loss.

Product descriptions, technical specifications, and photographs are prepared with the greatest possible care.

Minor cosmetic variations that do not affect functionality shall not constitute defects unless expressly stated otherwise.

Turn On Computer Resale GmbH shall only be liable as required by applicable law.

Nothing in these Terms excludes liability for:

• Intentional misconduct
• Gross negligence
• Injury to life, body, or health
• Mandatory statutory liability

German law shall apply.

For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected where applicable.

Where legally permissible, the place of jurisdiction for business customers shall be Weinheim, Germany.

If any provision of these General Terms and Conditions becomes invalid or unenforceable, the remaining provisions shall remain unaffected.
